Masterbid, Inc. and its representatives and associates are Exclusive Agents of the Seller.
All bidders must be registered. All bidders must register by returning to Masterbid, Inc. a signed acknowledgement of the terms and conditions and by providing his/her full name, current residence/business address, current phone number, email address a copy, scan, or recent digital photograph of their driver's license & their driver's license number.
Bidders are required to download the Lead Base Paint information pamphlet via the link provided before agreeing to these Terms and Conditions. Agreeing to these Terms and Conditions confirms your receipt of such information.
All bidders must provide current proof of capability of paying cash at closing and any Letters of Authority.
A current bank approval letter signed and dated by the bank, addressing this Auction.
Current Bank Statement
Corporation papers verifying authority of current power of attorney.
Any other Letters authorizing you on behalf of another person or entity.
By placing a bid, the bidder acknowledges that they understand and agree to be bound to the terms and conditions of this auction.
High Bidder to place a $5,000.00 (non-refundable upon buyers default) deposit down immediately following the close of the auction in cash or check U.S. funds is applicable to the purchase price. To use a Credit card add $150 credit card fee which is non refundable and not applied to the purchase price $5,150.00.
A ten percent (10%) buyer's premium will be added to the final bid. The final bid plus 10% will establish the selling price.
The closing will take place in approximately 30 days or as soon as the Title Company is ready.
The bidding and purchase are "Not" subject to obtaining financing or any other contingencies actual or implied. All financial arrangements must be made prior to the auction and purchasers must be capable of paying cash at closing.
Property is being sold "As Is", "Where Is", "With All Faults" "Buyer Beware" and without any guarantees or warranties of any kind.
The seller will provide a warranty deed and title insurance.
Any notice made after the initial posting of this auction will take precedence over any and all prior statements, correspondence, conditions, arrangements, and/or notices either verbal or written.

The Auctioneer is acting as an agent only and is not responsible for acts of its principals. Auctioneer reserves the right to add or withdraw items from the auction without notice. The Auctioneer reserves the right to reject any and all bids. Tim Narhi Auctioneer and Associates, LLC is not responsible for accidents or items after sold.

Tim Narhi Auctioneer & Associates LLC is providing online bidding, where applicable, as a service to the bidder. Bidder acknowledges and understands that this service may or may not function correctly. By placing a bid, bidder signifies that they have examined the items to their satisfaction, or that they have chosen not to personally examine them. Under no circumstances shall Bidder have any kind of claim against Tim Narhi Auctioneer & Associates LLC or anyone else if the service fails to work correctly before or during the auction. Tim Narhi Auctioneer & Associates LLC will not be responsible for any missed bids. Bidders should not wait until the last minute to bid, in case there is an error with the bidding service. Tim Narhi Auctioneer & Associates LLC reserves the right to withdraw or re-catalog items as they deem necessary, and reserve the right to cancel and/or reopen the auction in the case of system failures.
Dispute Resolution: Tim Narhi Auctioneer & Associates & all bidders & buyers knowingly, voluntarily, intentionally and irrevocably waive any right to trial by jury and agree to submit any claim or controversy arising out of any party matter to a bench trial (judge only, without jury). The prevailing party will be entitled to collect from the other its full costs associated with the court proceeding and any subsequent enforcement and collection costs, including reasonable attorneys' fees. Any court action must be commenced within one year from the date when the cause of action occurred (i.e., the date the breach, damage, injury, or event giving rise to such claim occurred, and not when discovered) or it will be barred. To the fullest extent allowed by law, no party will be liable for consequential, exemplary, incidental, indirect, punitive, or special loss or damage. Any award sought by buyer against auctioneer with the exception of the buyers attorney's fees & costs, will be limited to the sum actually paid by the buyer to the auctioneer under the terms of this agreement. Any award sought by auctioneer against seller, with the exception of auctioneers attorney's fees and costs, will be limited to the amount owed by the buyer to the auctioneer for buyers premium and monies owed on items in dispute that the auctioneer is due from the buyer under the terms of this agreement.
Choice of Law Jurisdiction, Venue: This agreement and any other matter will be exclusively construed and governed in accordance with the laws of the State of Michigan, without regard to conflict of laws principles. The exclusive jurisdiction and venue for any claim or controversy will be the County of Shiawassee in the State of Michigan. In the event of any conflict on choice of law, jurisdiction, or venue between this agreement and the terms of auction, this agreement will exclusively control the parties involved.
